1. The Department of Defense (DOD), in coordination with the Federal Aviation Administration (FAA), will conduct a flying photo op in the New York City Area on April 27, 2009 involving a transport and fighter aircraft. Below are the details regarding the operation.
• Date: Monday April 27, 2009 (Primary), April 28 or April 30 (weather backup dates)
• Number / Type Aircraft: 1 VC-25 and 2 F-16s. Actual photo op will only have VC25 and 1 F16.

• Flight Plan: Crews will file two separate IFR flight plans:

The aircraft will depart ADW via IFR clearance as a three (3) ship formation to Sea Isle (SIE). At SIE one (1) of the fighters will leave the flight and return to ADW IFR via SIE ATR V308 BILIT ADW.
The VC25 and 1 F16 will proceed IFR to CAMRN intersection south of JFK. In the vicinity of CAMRN intersection the aircraft will cancel IFR and proceed VFR with New York TRACON (N90) towards the Verranzano Bridge. N90 will hand the aircraft off to Newark Tower (EWR) for the flight in the Upper NY and Newark Bay. Upon completion of the final pass the aircraft will be treated as a EWR departure and pickup an IFR clearance back to ADW.
The photo op portion of the flight will be VFR in accordance with the specified ground track as per the attached map (Attachment 1). On the northbound flight segments the fighter aircraft will be offset to the east by approximately ½ mile. During the southbound flight segment the fighter will re-position to remain offset to the aircraft within the depicted box.
The operation will be monitored by FAA Air Traffic Security Coordinators (ATSC) at the Domestic Event Network at FAA Headquarters from start to finish. Any questions or issues can be directed to the FAA ATSC at the DEN. The FAA ATSC can be reached at (202) 493-5107.

The current crisis is Obama having declassified and released memos detailing the programs used to question al Qaeda suspects. Is water boarding torture, did it violate U.S. and international laws? Intel and congress knew attacks were imminent. Intel and congress knew exactly what was happening at Guantanamo. Peter J. At the very least, if Obama wants to declassify details of the programs, he needs to declassify the findings as well. By all accounts they acted legally within the interpretation of the law. Over 20 people have been killed after a firefighting system went off during sea trials on board the Nerpa, a nuclear submarine in Russia’s Pacific Fleet. Black, White, Yellow, or any other shade of peoples, Americans must believe in Red, White and Blue on Election Day. The world looks to America for leadership and stability and when we deviate in our path of Democracy and fair elections, we subject ourselves to further erosion of our power to the world. America and it’s allies helped allow for the first voting in 50 years in Iraq with the means of dipping a finger into purple ink, it is not so easy to identify a voter in America, nor should it be. There is a whole variety of problems that we can anticipate. In early voting, usually in favor of Democratic Candidates, we have already seen challenges at the polls. On Election Day, indeed we may have voting machine manipulation and malfunction, polling places that run out of paper, long lines, and a potential that precincts could be overwhelmed by an outpouring of voters. Just imagine in Chicago, if the turnout is so massive with 8 hour waits and not every voter gets to vote, what kind of voter unrest could occur?
Only last year, with the results from Kenya’s closely contested elections still up in the air and evidence growing of election mischief, riots and ethnic clashes erupted across the country. Kenya is east Africa’s most stable and prosperous democracy but rioting killed hundreds after the election. Raila Odinga, who was leading in the polls prior to the election was the candidate Obama had been campaigning for but he lost his election to Mwai Kibaki. All the more reason that Obama’s lack of interference in his Aunt Zeituni’s plea for US Asylum seems suspect.

This historic presidential contest will feature either America’s first black President or first female Vice President. Iraqi’s went to the polls in the face of real threats, I don’t think Americans will. We’ve seen “emergency-preparedness” steps taken in Denver before the DNC and at every campaign rally Obama and McCain have attended and nothing major has happened. We’ve prepared for Y2K and nothing happened. In case all hell breaks loose, we will be duly prepared in major cities and do not forget that the Army’s Brigade Homeland Tour of U.S. Combat troops have been repatriated from Iraq to help with any civil unrest.

President Roosevelt once said, “In politics there are no accidents. If it happens you can bet it was planned that way.” I hardly think people will take to the streets, nor will the service of the Army, The National Guard, or riot troops be necessary. We are a patient people and have endured two years of campaigning with no unrest. Election Day occurs on a school and work night with honest to God people who have to get up and go to work, and many of McCain supporters will be sleeping well before the results are in. No matter who wins, I believe in widespread respect for the law and while I encourage you to vote McCain, my prediction is that nothing will happen. That’s my theory anyways.

Ah, but what about the Posse Comitatus Act? The Posse Comitatus statute generally prohibits federal military personnel and units under federal authority from acting in a law enforcement capacity within the United States, except where expressly authorized. Authorized by whom? You may remember, that The Posse Comitatus Act is often mentioned when it appears that the Department of Defense is treading on thin water or interfering in domestic disturbances.
With little fan fair from the media, the Army has been authorized and ready, having just completed a mission rehearsal in mid September at Fort Stewart. The Army is now on active duty and ready to protect Americans on American Soil.
US Army announced “that the 3rd Infantry Division’s 1st Brigade Combat Team (BCT) will be under the day-to-day control of US Army North, the Army service component of Northern Command (NORTHCOM), as an on-call federal response force for natural or man made emergencies and disasters, including terrorist attacks. These soldiers will also learn how to use non-lethal weapons designed to “subdue unruly or dangerous individuals” without killing them.” Gee, I feel better already. OMG- these troops just finished a tour in Iraq, we’re talking some bad ass mother f’ers here.
Was it the Patriot Act, the John Warner Defense Appropriation Act, DOD, etc., that allowed for the obvious and blatant disregard of the Posse Comitatus Act?? Near as I can tell, President Bush Signed H.R. 4986, the National Defense Authorization Act for Fiscal Year 2008 into Law where by under 18 U.S.C.983 ” the Attorney General may request that the Secretary of Defense provide emergency assistance if civilian law enforcement is inadequate to address certain types of threat involving the release of nuclear materials, such as potential use of a nuclear or radiological weapon. Such assistance may be by any personnel under the authority of the Department of Defense, provided such assistance does not adversely affect U.S. military preparedness. ” So there we have it, the Attorney General and “any personnel under the DOD” gets to decide when things are haywire enough to require the Army to intervene. Presently, Attorney General Michael Mukasey is busy appointing a prosecutor to investigate whether his predecessor Alberto Gonzales and others involved in the firings of nine US attorneys broke the law. I guess we are safe. (BTW-just when did having a job with the Federal Government preclude one from getting fired??}
