Obama Birther Lawsuit, In Contempt?

President Obama may be in contempt if he fails to show up tomorrow in a Georgia court.  The main complaint claims he is not a natural born citizen and should not be permitted on the Georgia ballot for re-election.

Yup, we’ve heard it all. The birth certificate was forged, his dad was born in Kenya, etc.  No one has followed the events surrounding Obama’s citizenship better than http://citizenwells.wordpress.com/.

Deputy Chief Judge Michael Malihi on Friday, denied a motion by the president’s lawyer to stop a subpoena that requires Obama to show up in person.

His Order on Motion to Quash Subpoenas:

ORDER ON MOTION TO QUASH SUBPOENAS

Defendant, President Barack Obama, a candidate seeking the Democratic nomination for the office of the President of the United States, has filed a motion to quash the subpoena compelling his attendance at the hearing on January 26, 2012.

In support of his motion, Defendant argues that “if enforced, [the subpoena] requires him to interrupt duties as President of the United States” to attend a hearing in Atlanta, Georgia. However, Defendant fails to provide any legal authority to support his motion to quash the subpoena to attend. Defendant’s motion suggests that no President should be compelled to attend a Court hearing. This may be correct. But Defendant has failed to enlighten the Court with any legal authority. Specifically, Defendant has failed to cite to any legal authority evidencing why his attendance is “unreasonable or oppressive, or that the testimony… [is] irrelevant, immaterial, or cumulative and unnecessary to a party’s preparation or presentation at the hearing, or that basic fairness dictates that the subpoena should not be enforced.” Ga. Comp. R. & Regs. r. 616-1-2-.19(5).

Defendant further alludes to a defect in service of the subpoena. However, the Court’s rules provide for service of a subpoena upon a party, by serving the party’s counsel of record. Ga. Comp. R. & Regs. r. 616-1-2-.19(4). Thus, the argument regarding service is without merit.

Accordingly, Defendant’s motion to quash is denied.

There is not one, but four cases regarding Obama’s eligibility.

 

In response to the conspiracy theories, the White House released the President’s long-form birth certificate on April 27, 2011, reaffirming that he was born at 7:24 pm on August 4, 1961, in Honolulu, Hawaii. Nearly 3 years after the eligibility questions arose.

Therefore, what does this mean to attorney Van R. Irion, Rep. Mark Hatfield and attorney Orly Taitz?  EVERYTHING.  The U.S. Supreme Court case Minor v. Blame it all on Secretary of State Hillary Clinton.  Lawyer Phip Berg was a supporter of her candidacy for President.  Way back in 2008, Berg filed the first legal challenge to Obama’s constitutional eligibility to occupy the Oval Office.

The Georgia Democrats’ attorney, Mike Jablonski, could walk into the January 26 administrative hearing with a self-authenticating, certified copy of President Obama’s birth certificate and hand it over to Deputy Chief Judge Michael Malihi. Where is Newt, Paul, Santorum and Gingrich’s comments?  Mum.  Romney can’t say much either.  People are now beginning to question Romney’s citizenship.

Mitt Romney’s great-grandfather, faced in 1884 with arrest for the practice of polygamy, packed up his five sister-wives and progeny and high-tailed it south of the border to Mexico. Mitt’s father George Romney was born in Mexico, which conferred Mexican birthright citizenship to him regardless of his parents’ nationality.

I know, you’re saying to yourself, this is crazy! It doesn’t matter where George Romney was born because his parents were Americans. George Romney even pursued the presidency himself in 1968 and his eligibility was not questioned. The first Chief Justice of the United States, John Jay, to George Washington in 1787 in a letter wrote:

Permit me to hint, whether it would be wise and seasonable to provide a strong check to the admission of foreigners into the administration of our national Government; and to declare expressly that the Commander in Chief of the American army shall not be given to, nor devolve on any but a natural born citizen.

National Guard Not Going For Immigration Border Patrol

The National Guard is headed for the Mexican U.S. border.http://www.nationalguard.com/  President Obama in his infinite wisdom or, from reading the Nation’s leading poll’s supporting Arizona’s immigration law( http://www.rasmussenreports.com/public_content/politics/obama_administration/daily_presidential_tracking_poll ) is sending troops.  It is not so obvious that it is for immigration control, as the Mexican Embassy point out that troops will be on guard against the illegal flows of weapons and bulk cash into Mexico, which provide organized crime with its firepower and its ability to corrupt.

Regarding the Administration’s decision to send 1,200 National Guard servicemen to the US Southern border, the Government of Mexico trusts that this decision will help to channel additional US resources to enhance efforts to prevent the illegal flows of weapons and bulk cash into Mexico, which provide organized crime with its firepower and its ability to corrupt.

Additionally, the Government of Mexico expects that National Guard personnel will strengthen US operations in the fight against transnational organized crime that operates on both sides of our common border and that it will not, in accordance to its legal obligations, conduct activities directly linked to the enforcement of immigration laws.

Mexico is determined to continue working on its side of the border to enhance the security and well-being of border communities, and to deter and dismantle organized crime and its links to drug trafficking and human smuggling.

As part of our joint strategy in the fight against transnational organized crime, there are actions that our two governments have undertaken together, and there are other measures taken independently by Mexico and by the US within their respective territories. In this regard, the Mexican Government fully respects the sovereign decisions of the US Government, but underscores that joint responsibility must continue to underpin our joint efforts in rolling-back transnational organized crime operating on both sides of the border.

As the commander-in-chief, I believe he is supposed to be in charge of the Nation’s Military, not states National Guard troops.  Others are of the same opinion:

“There is no modern precedent for Congress to direct the president to deploy troops in the manner sought by the Amendment,” National Security Adviser James Jones and Homeland Security and Counterterrorism Adviser John Brennan wrote to Senate Armed Services Committee Chairman Carl Levin (D-Mich.)

USARNORTH conducts Homeland Defense and Civil Support operations, and Theater Security Cooperation activities, as the U.S. Northern Command Joint Force Land Component Command and the Army Service Component Command in order to protect the American people and their way of life.

We have U.S. Servicemen and women on active duty on U.S. soil in violation of Posse Comitatus. If we are breaking protocol anyway, why not get it over with and send the military to secure the border with Mexico? “…to protect the American people and their way of life!”

Our borders are being overwhelmed by Mexican people crossing into the greatest country on earth, illegally.  We are fighting wars in Iraq and Afghanistan.  North Korea and South Korea are playing a deadly game of tit for tat, and China’ aggression towards the U.S. has been pretty clear while it remains our largest debt holder.  Oil is spilling by thousand’s of gallons every day. 

Where is our commander-in-chief?

Obama will travel from Washington to Chicago on Thursday for a long weekend with his family, as planned. On Monday, Obama is scheduled to participate in a Memorial Day ceremony at Abraham Lincoln National Cemetery in Elwood, Ill.   In Obama’s absence, Vice President Joe Biden will participate in the customary wreath-laying ceremony at the Tomb of the Unknown Soldier at Arlington National Cemetery outside Washington.

Birther Debate Rages on Over Obama Birth Certificate in Hawaii

Is President Obama a natural born citizen to meet the qualifications as required by The Constitution to hold the office of Presidency?  Who really knows?

Just when you thought Obama’s past was all swept tidily under the rug, along with his associations with Retzo. Ayers, and Blago along comes the state of Hawaii to introduce new legislation regarding the access of birth certificates.  Read the bills here and here. Democratic state Sen. Will Espero, who  introduced the two bills, says does not necessarily believe that everyone should see birth certificates that are now restricted.

Janice Okubo commenting on the number of requests for Obama’s birth certificate, said:  

“They’re spurred on by these ‘birther’ blogs who direct them to bombard the Health Department even though they have no legitimate right to the information.”

Excuse me, no legitimate right?”  We’re all for protecting identity theft, but we are also 1000 percent sure that the Constitution obligates a candidate and President to prove he is eligible.  To say that I, you, we and all Americans “are not entitled” is grossly abhorrent and negligent in upholding the law.

You’ll recall during the election,  “Hawaii Health Department spokeswoman Janice Okubo told the Tribune state privacy laws and attorney general guidance barred her from confirming the certificate’s authenticity. But, “It looks exactly the same as my own birth certificate,” Okubo said.”  HOW DOES OKUBO KNOW WHAT IT LOOKS LIKE?  http://www.upi.com/Top_News/2008/10/30/Rumor_questions_Obamas_birth_certificate/UPI-64261225393575/ 

Later of course, as reported by (AP) – State officials say there’s no doubt Barack Obama was born in Hawaii.  Health Department Director Dr. Chiyome Fukino says she and the registrar of vital statistics, Alvin Onaka, have personally verified that the health department holds Obama’s original birth certificate.  Governor Lingle never approved Fukino’s viewing-, they acted as a private citizens looking into someones private document in violation of  Hawaii law but no repercussion has come to them. 

American Thinker wrote:

Contrary to what you may have read, no document made available to the public, nor any statement by Hawaiian officials, evidences conclusively that Obama was born in Hawaii…The question not being asked by the holders of power, who dismiss this as a rightwing conspiracy, is what’s the downside of disclosing?  This is a legitimate issue of inquiry because Barack Obama has turned it into one.  The growing number of people who demand an answer in conformance with the Constitution are doing their work; the people’s watchdogs aren’t. http://www.americanthinker.com/2008/11/why_the_barack_obama_birth_cer.html

Press Secretary Gibbs has had enough,  saying that there are 10,000 other things to worry about than whether the President is a citizen.  One poster, dacapitain84, at the YouTube site had this to say in reply: 

Hey Gibbs, Give me a birth certificate, photoshop and 30 minutes; and I’ll show you that Obama was born on Mars. Fuck you Gibbs.

“Under the proposed legislation, people who persist on making requests would be declared a “vexatious requester” by the Office of Information Practices, which would place restrictions on accessing government records for two years,” says the JDJournal at http://www.jdjournal.com/2010/03/17/birthers-beware-hawaii-looks-to-put-stop-to-obama-requests/.

Two years?  Just about the time the Obama’s term comes to an end.  He could run for office again, but next time around we highly doubt, based on his approval ratings he will have a chance in hell of winning.

For Orly Taitz, Philip J. Berg,  Andrew Martin, Citizen Wells, Alan Keyes, Donofrio and the others who have taken challenge with Obama’s birth certificate in a court of law, certainly this is just another brick in the wall

Citizen Wells Takes on Glen Beck

“Glenn Beck insults Americans, military, US Constitution, Citizen Wells red phone challenge!

Unlike Lou Dobbs, who on CNN of all places, asked the basic journalistic question, why doesn’t Obama present a legitimate birth certificate, Glenn Beck, on his radio  and Fox TV show has insulted millions of concerned Americans. Many of these Americans are current and retired military and quite a few high ranking officers. Beck often talks out of one side of his mouth about upholding the US Constitution, while at the same time insulting Americans exercising their First Amendment rights.

Three concerned Americans, Philip J Berg, a lifelong Democrat, former ambassador Dr. Alan Keyes and Charles F Kerchner, USNR Commander, all requested Obama’s college records using legal channels and were opposed by Obama attorneys.

Glenn Beck, et al, the above question is simple to answer, simple enough for a fifth grader. Lou Dobbs, while still at CNN, asked another simple question. Why doesn’t Obama just provide a legitimate birth certificate. However, Glenn Beck, the eligibility issues surrounding Obama appear to be too complex (or controversial) for you. You know, messy stuff like natural born citizen and the US Constitution. So I have decided to just focus on something real simple for you, something you can get your head around. Obama’s college records. That’s not too complex or controversial is it?

Glenn, perhaps even you at one time or another had to prove you attended a school.

Glenn Beck, you inspired me with the red phone you set up to receive calls from the Obama Administration. So I have dedicated a phone to receive calls from you. If anything I write or put in a video is incorrect, please call me anytime and let me know. The follow video, let’s call it a trailer for upcoming shows, presents some information regarding efforts to obtain Obama’s college records. I will be curious to know if you consider the three men referred to in the video as right wing idiots.  One of them is a retired military officer. You have insulted plenty of them in the past, so why not. Heck, you will probably call me an idiot. However, I must warn you, I fight back. I will not back down.

The Census, What Race is Obama?

The Census is a big reflection of who our Nation is.  ” This data is used to determine the appropriate number of seats in the House of Representatives.  It provides key population numbers for Congress and the Administration to determine how federal dollars flow to the states and the data is used by researchers, advocates and policy makers to develop reports, social service programs, and make critical policy decisions.” 

They’re here, they’re queer and want to be counted in the U.S. Census. 

It’s crazy – the U.S. Census Bureau wants an accurate count of everyone in the country – but there’s no question in the survey that asks if you are lesbian, gay, bisexual or transgender.  http://www.queerthecensus.org/site/c.jeJLIVOxEnH/b.5474287/k.9C4D/Queer_the_Census.htm 

If you are gay, green, transgender or whatever the census helps determine districts and funding.  Asking or telling if you are gay is not relevant, you are an American filling out a piece of paper.  End of story. I don’t yell out what I do under the sheets and I don’t want to hear about you being a queer.  To be referred to as queer,  the census must be rude for so many yet,  “For the first time in history, the Census will count both unmarried same-sex partners and legally married same sex spouses in its survey! This advancement is due in great part to advocacy by the Task Force, and our members and supporters.” Again, what does it matter?  No one gets married, homo or heterosexual on the basis of what district you live in.  Unless maybe it is 90210- Beverly Hills!

The programmatic risk relies on the post office ensuring delivery of the census and its return back to the government.   As for hard to reach populations, where in America is there a hard to reach population?    American Samoa where we shipped Guantanamo Bay refugees?  Do we get to count our servicemen and woman even though most of their votes were not counted in the election?

The bigger problem and most offensive is to the black or negro population, as the census refers to-  is for people who are not white.

But some blacks have complained that one of the form’s questions is outdated, offensive, and a throwback to the Jim Crow era.   Question No. 9 on the form asks: “What is Person 1’s race?”  The first selection, no surprise, is White. The second box includes choices in the following order – Black, African-Am., or Negro. Obama to Release Birth Certificate in Hawaii

President Obama will release his birth certificate while on his Hawaiian vacation!  You believe that, I’ve got some carbon credits to sell, cheap! 

Interrupting his vacation in Hawaii for the second time, instead he spoke about the Christmas attempted airplane bombing.

“Had this critical information been shared, it could have been compiled with other intelligence, and a fuller, clearer picture of the suspect would have emerged,” Obama said in a brief statement to the media. “The warning signs would have triggered red flags, and the suspect would have never been allowed to board that plane for America.”  Officials said Obama chose to make a second statement in as many days because a morning briefing offered him new information in the government’s possession about the suspect’s activities and thinking, along with al-Qaida’s plans.http://www.breitbart.com/article.php?id=D9CTB5BG0&show_article=1

While in Hawaii, President Obama ought to put an end to all the birther arguments that he is not a usurper, but we all know that is not going to happen.  As he mentions in his press statement- “intelligence for a clear picture,” the red flags still exist regarding his citizenship.  Numerous court cases have challenged President Obama’s natural born citizenship under Article II, Section 1 of the United States Constitution that says that the president be a “natural born citizen.”  Only he can make them go away.

Hawaii officials haven’t helped matters, issuing statements claiming that they have President Obama’s authenticated copy- alas, not an original as they made the switch to electronic documents years ago.  So what kind of document has fact check been presenting all this time?  A forgery? Berg, Wells, Donofrio, Martin and others have sought to use the courts in a reasonable, mostly respectful  manner to require President Obama to produce his birth certificate.  Obama continues to waste the courts time and money to keep it sealed.  What is there to hide.  The Truth?

Rallies and Protests with guns? Organize militias?  The Tea Party mentality of today does not advocate violence against anyone, only peaceable change mainly by voting out officials.  Maybe she posted drunk on eggnog? Whatever credibility she had, is gone.

(There is no existing evidence that Obama was ever naturalized.) Nor would he qualify to be a United States citizen by any act of Congress by being born abroad to a United States citizen parent. If this scenario were proven to be true (being neither a born nor a naturalized citizen), it can be reasonably argued that Obama is an undocumented alien. Obama has refused to release his identity documents to the public which causes such theories to exist. It is this reason which shows the importance of the American people being able to access Obama’s records (birth certificate, travel, education, and employment records) to intelligently learn his exact citizenship status. Surely, the United States cannot have a possible undocumented alien be its President. Imagine the merits or detriments that could occur if President Obama himself, personally went to collect his birth certificate with the news media in tow.  That would make a wonderful way to begin the New Year, with truth, honesty, integrity and transparency.

National Guard to Administer H1N1 Swine Flu Shots

The U.S. military wants to establish regional teams of military personnel to assist civilian authorities in the event of a significant outbreak of the H1N1 virus this fall, according to Defense Department officials, wrote CNN in late July.  http://edition.cnn.com/2009/US/07/28/military.swine.flu/

We are now well into fall and the midst of falling leaves.  It is the season Halloween antics, but it is no treat to witness the trickery of government and using the military to curb the Pandemic Flu.

In Hawaii Gov. Linda Lingle was praising her states vaccine campaign for school children.  “Hawai’i became the first state to offer free flu vaccine to elementary and middle school students statewide. “That’s why we’re so well positioned for the H1NI (swine flu)” vaccination campaign, Lingle said.” http://www.honoluluadvertiser.com/article/20091014/NEWS15/910140325/School+flu+inoculation+begins

Eventually, she said, the Department of Health and the Hawai’i National Guard would be administering swine flu vaccine to the general public statewide.”It’s not just going to be children, or course,” Lingle said. “It will be everybody.”

If Hawaii is so well prepared, why will the National Guard be administering H1N1 Swine Flu vaccines?  Where are all the doctors, nurses, flu clinics at Wal-Mart, pharmacies and support personnel?

“It will be everybody?”  Is she giving advance notice that there are plans to make the H1N1 Influenza Swine vaccine mandatory in Hawaii? 

Acting Secretary Charles E. Johnson announced the determination that a public health emergency existed nationwide. Secretary Kathleen Sebelius renewed that determination on July 24, 2009. These actions taken were under the Public Health Service Act § 319 (42 U.S.C. § 247d). This translates to the fact that under this act Army, Navy, Marines, Air Force and  maybe the Coast Guard too, can be used as any means necessary to combat the spread of H1N1. 

The Maine National Guard has stepped up its efforts and getting involved when it comes to combating the H1N1 virus. News 8’s Steve Minich reports here:

The National Guard, however, will not distribute the H1N1 vaccine on its own. The National Guard will not obtain any of it directly … unless it is specific to their state and it’s in their state plan,” said Army Capt. The use of military assets in civilian law enforcement remains illegal under posse comitatus unless a clear state of emergency exists. Is vaccinating everyone in Hawaii a state of emergency? Apparently Lingle thinks so.

Hawaii’s laws, from the release of President Obama’s birth certificates to the use of the National Guard, sure are different that most of the mainland U.S.

A poster featuring President Barack Obama portrayed as Heath Ledger’s famous Joker are surfacing in the  Los Angeles with “socialism”  beneath him.

The Obama Joker poster is showing up on off-ramps and underpasses in Hollywood, California. Whomever made and distributed copies of the poster has chosen so far to remain anonymous.  Due props to the mysterious man or woman.

From birthers to plain old Americans who still believe in the Constitution of The United States of America that says that a president must be a natural born citizen, it sure would be nice to know the truth about President Obama’s birth certificate records.

Now comes the emergence of a Kenyan birth certificate from Orly Taitz. 

HuffPost has disputes its authenticity as does Karl Rove, saying:

  • Kenya was a Dominion the date this certificate was allegedly issued and would not become a republic for 8 months.
  • Mombasa belonged to Zanzibar when Obama was born, not Kenya.
  • Obama’s father’s village would be nearer to Nairobi, not Mombasa.
  • The number 47O44– 47 is Obama’s age when he became president, followed by the letter O (not a zero) followed by 44–he is the 44th president.
