Obamacare, Liberty, and Justice for All Gets Challenged in The Supreme Court

The Supreme Court has scheduled a six hours for oral arguments regarding Obamacare March 26–28, 2012. The case is more formally known as The Patient Protection and Affordable Care Act (PPACA). That law along with the Health Care and Education Reconciliation Act are the basis of health care reform that were signed into law by President Barack Obama on March 23, 2010.

The law REQUIRES people who do not have employer or government health insurance to buy essential health insurance.  It is also know as the “individual mandate.”  Ironically, the phrase never appears in the 2,409 page mandate.  It also puts penalties on employers who do not provide health insurance directed by politicians standards.  “The National Federation of Independent Business (NFIB)—the nation’s largest small-business advocacy organization—has joined the ranks of twenty state attorneys general in a lawsuit attacking the constitutionality of President Obama’s new healthcare law.”  http://news.heartland.org/newspaper-article/national-small-business-organization-joins-lawsuit-against-obamacare

Obama, who claims to be a Constitutional scholar has failed to take note that the law he signed is in defiance of the 10th amendment which grants the enumerated powers to the State, not the Federal Government.  Nearly half of the America States are suing to stop this absurd abuse of power.

Regulation of non-economic activity under the Commerce Clause is possible only through the Necessary and Proper Clause. The Necessary and Proper Clause confers supplemental authority only when the means adopted to accomplish an enumerated power are ‘appropriate’, are ‘plainly adapted to that end’, and are ‘consistent with the letter and spirit of the constitution.’ Requiring citizen-to-citizen subsidy or redistribution is contrary to the foundational assumptions of the constitutional compact. (Case 3:10-cv-00188-HEH, Document 1. If the Federal Government is allowed to make you buy insurance, what else can it make you do? We already know it make you pay taxes, and there in is a precedent for this case.  Could the government make you subscribe to a National ID? A vaccination? A RFID Tag? Mandatory Military or Civil Service? Take your land? Stop you from owning a legal firearm?

Executive Orders require no Congressional approval but have the same legal weight as laws passed by Congress. The President’s source of authority to issue Executive Orders can be found in the Article II, Section 1 of the Constitution which grants the President “executive Power.” Section 3 of Article II further directs the President to “take Care that the Laws be faithfully executed.” To implement or execute the laws of the land, Presidents give direction and guidance to Executive Branch agencies and departments, often in the form of Executive Orders.

What is most striking is Obama’s first executive order was to seal all presidential records. Ohbamababy, what is there to hide? 

After flubbing Obama’s swearing in, in an “abundance of caution,” Chief Justice John G. Roberts, Jr. had once again administered President Barack Obama’s swearing-in as they stood in the Map Room of the White House.

I’m really surprised that anyone was taken in for a moment by Obama and Roberts “flubbing” the oath of office. Obama knows perfectly well that he is not an American citizen and so cannot legally take the oath. This little charade he played out with Roberts was obviously designed to cover up the fraud. Now we know why the Supreme Court refused to hear the birth certificate case — Roberts was in on it from the beginning.

There is media blackout in effect on the most controversial story of the Obama presidency. And just what the heck is Obama talking about regarding missile defense with Russia?  Caught on a hot mike- “President Obama: This is my last election. The Supreme Court has failed to hear eligibility cases that would make everything he has ever done, moot.  So now we have to have faith that when the Court issues its ruling, expected sometime in June, that it will put an end to this nonsense.

The Senate-passed bill cleared the House on a 219-212 vote and is now on it’s way to President Obama’s desk for signing.

With an estimated 10-year cost of $894 billion, that comes out to about $2.24 million per word….Republicans aide said a print-out of the bill weighs more than 19 pounds and stands nearly nine inches tall. 

How fast can Obama read it?  Will he even bother, or just sign it again avoiding the transparency he promised and repeatedly has broken?  The legislation still is not posted at http://www.whitehouse.gov/

The Obama Administration officially abandoned the President’s “Sunlight before Signing” campaign pledge [volokh.com] that the White House would post all legislation passed by Congress for at least five days before the President would sign it. In making this announcement, the Administration maintained that it would comply with the spirit, if not the letter, of the original commitment by posting legislation on the White House site once it became clear legislation would eventually pass and make it to the President’s desk. This new commitment, they suggested, would actually provide even greater sunlight, as some bills would be available for review earlier and for a longer time. To provide affordable, quality health care for all Americans, Harry Reid http://reid.senate.gov/ has ensured that this can never be repealed. From an email we received:

Beginning on page 1,000 of the measure, Section 3403 reads in part: “it shall not be in order in the Senate or the House of Representatives to consider any bill, resolution, amendment or conference report that would repeal or otherwise change this subsection.” 

In other words, if President Barack Obama signs this measure into law, no future Senate or House will be able to change a single word of Section 3403, regardless whether future Americans or their representatives in Congress wish otherwise.
Note that the subsection at issue here concerns the regulatory power of the Independent Medicare Advisory Board (IMAB) to “reduce the per capita rate of growth in Medicare spending.”

Will  Obama’s Kenyan aunt Zeituni Onyango qualify for universal health care too?  Her pre-existing condition of Guillain-Barré syndrome would certainly be covered.  Is she still collecting benefits?  Wonder where she is living?

This legislation will not fix everything that ails our health care system. But it moves us decisively in the right direction. This is what change looks like.”

Voting For or Against The Bill

The NYTimes http://www.nytimes.com/interactive/2010/03/22/us/politics/20100322-group-vote-chart.html today takes, “A look at some important groups in Sunday’s House vote to pass the health care bill approved by the Senate in December.”  It also lists each and everyone of the bastards that voted for this abomination.  

President Obama is expected to sign the health care bill Tuesday at the earliest. Only then can the Senate begin dealing with the reconciliation package.  According to Senate rules, members are allowed to offer unlimited amendments and challenges to the reconciled bill….Boehner had said the revised health care bill was worse than the original legislation, adding that the “American people are going to hear about every payoff, every kickback and every sweetheart deal that comes out.” http://www.cnn.com/2010/POLITICS/03/22/senate.health.care.ahead/

As the Senate still has to sign off on the changes, every single member needs to read the U.S. Constitution, occupying four sheets of parchment, containing 4, 543 words that clearly outline why this piece of legislation is illegal.

Every Bill which shall have passed the House of Representatives and the Senate, shall, before it become a Law, be presented to the President of the United States; If he approve he shall sign it, but if not he shall return it, with his Objections to that House in which it shall have originated, who shall enter the Objections at large on their Journal, and proceed to reconsider it. If after such Reconsideration two thirds of that House shall agree to pass the Bill, it shall be sent, together with the Objections, to the other House, by which it shall likewise be reconsidered, and if approved by two thirds of that House, it shall become a Law. But in all such Cases the Votes of both Houses shall be determined by Yeas and Nays, and the Names of the Persons voting for and against the Bill shall be entered on the Journal of each House respectively

The majority of the American people object, Mr. President.

Just 41% of voters favor the plan while 54% are opposed. Those figures include 26% who Strongly Favor the plan and 45% who are Strongly Opposed. Most voters believe it will raise the cost of health care and reduce the quality of care. Still, nearly two-out-of-three voters believe it is at least somewhat likely to pass and become law.

From a political perspective, 50% of voters are less likely to vote for a Member of Congress who supports the health care reform plan proposed by the President and Congressional Democrats. How can anyone figure out The Heath care Reform Bill when people can’t even figure out the Tax Code?

Republican Rep. Jason Chaffetz, R-Utah, is irked that nearly 100,000 civilian federal employees owe the IRS $962 million in back taxes. He thinks they should pay up or be fired.   Chaffetz has introduced a bill that calls for the federal government to “ferret out” civilian employees who have “seriously delinquent tax debt” and prevent the hiring of other tax delinquents.  More than 3 percent of the 2.8 million federal civilian employees owed the Treasury unpaid federal income taxes in 2008, according to the IRS. Laying the pages end to end it would be over 2.5 miles  The average reader would take 31 days of non stop reading to read all of the tax codes.

Americans won’t need a barcoded bracelet or an RFID tag especially if we have government-run health care.

Yesterdays commentary was about a huge undertaking by the FDA, and insurance companies ability to track prescriptions given to pregnant women-

A new research program called the Medication Exposure in Pregnancy Risk Evaluation Program (MEPREP) will fund research to study the effects of prescription medications used during pregnancy. The program is a collaboration among the U.S. Food and Drug Administration and researchers at the HMO Research Network Center for Education and Research in Therapeutics (CERT), Kaiser Permanente’s multiple research centers and Vanderbilt University.

Collectively, the 11 participating sites have health care information for about 1 million births over the past seven years (2001-2007). Many of the mothers associated with these births likely used medication during their pregnancies and now, with the program in place, the FDA and participating researchers have a systematic and timely way of retrieving information from this network.http://www.fda.gov/NewsEvents/Newsroom/PressAnnouncements/ucm1959

That is 11 million patient records out there for study and review and I bet my bottom dollar, that the patient’s history did not specifically express that the information was going to be gathered for analysis and held for years.

Read that fine line before signing where you authorize the physician or hospital to share your information.  Of course, if you want insurance you are going to sign- it’ll probably be just mandatory under government run health care.

Ring, ring.  ” Hi, this is Kaiser Permanente, the largest managed care organization in the United States and we’re conducting a study.  We were just wondering if those anti-depressant medications, antibiotics, and or cardiovascular medications you might have taken while you were pregnant gave your child birth defects or caused any perinatal problems?”

Did any pregnant mom systematically give permission to have their data used in this study?  Was there “informed consent,” that prescription data could be used in future studies?  We realize this is probably just an aggregate of data from various clinics, but everyone of those patients has a name and now are being used by a group of researchers to evaluate perscriptions drugs taken while pregnant.  “In 2007, Kaiser it completed the four-year implementation of the Kaiser Permanenteprescriptions HealthConnect technology system, which standardizes technology across all locations.”  http://www.wetfeet.com/Employers/Kaiser-Permanente.aspx What perfect timing!

Will the study look at race, age, and socio-economic factors as well?  How much do you think they know about these women?  About the children?

 

Smoking, drinking, and drug abuse are on the list as no no’s, but why is it the FDA now only taking action?  Reading the small print on most medications, including the H1N1 Swine Flu vaccines patient inserts, “product may not be safe for use during pregnancy, benefits outweighing risks, etc.” 

Why is it that the FDA is procuring this study as opposed to the pharmaceutical manufacturers themselves?  Oh, that’s right- many are already released from any liability from injury -as is the case with the H1N1 vaccines.  We have doubts that the outcome of this study will gain as much information as the government’s coordinated data effort which failed to reveal potential terrorists based on the events of 9-11, and as recently as on Christmas Day. 

 

The stimulus package, officially the American Recovery and Reinvestment Act, includes $8.2 billion in “extramural” NIH funding to help stimulate the U.S. economy by supporting scientific research.  Kaiser Permanente has won more than $54 million in federal stimulus funding to conduct research on many public and clinical health areas, including $25 million for genetic research in Northern California. http://sanfrancisco.bizjournals.com/sanfrancisco/stories/2009/10/12/daily1.html

According to the Congressional Budget Office, the House Health Care bill would cost $894 billion over 10 years and extend insurance coverage to 36 million, covering 96 percent of Americans. This morning, Speaker Nancy Pelosi will unveil(ed)  the re-tooled Affordable Health Care for America Act (HR 3962). At the moment, “House Democrats do not have firm commitment from enough lawmakers to guarantee passage of their bill.” One whip count has shown 23 centrist Democrats intend to vote against any health bill. Assuming that all Republicans vote against it, the bill can lose at least 38 Democrats and still pass the chamber.

Just what kind of data are they collecting and monitoring and who has access to it?  The information will be floating on the net and hackers and governments alike could have access to your personal and private information.  I’ll bet the insurance companies would love to get a hold of the data to access your medical records, pre-existing conditions, etc.

I am skeptical of every politician, especially President Obama.  At Kennedy’s eulogy, The President had the perfect opportunity to rub health care reform in my conservative face.  He mentioned it it of course, but spoke with class in part saying:

We cannot know for certain how long we have here. We cannot foresee the trials or misfortunes that will test us along the way. We cannot know God’s plan for us.

What we can do is to live out our lives as best we can with purpose, and love, and joy. We can use each day to show those who are closest to us how much we care about them, and treat others with the kindness and respect that we wish for ourselves. We can learn from our mistakes and grow from our failures. And we can strive at all costs to make a better world, so that someday, if we are blessed with the chance to look back on our time here, we can know that we spent it well; that we made a difference; that our fleeting presence had a lasting impact on the lives of other human beings.” 

Maybe he wrote it.  More likely a speechwriter.
