Obamacare, Liberty, and Justice for All Gets Challenged in The Supreme Court

The Supreme Court has scheduled a six hours for oral arguments regarding Obamacare March 26–28, 2012. The case is more formally known as The Patient Protection and Affordable Care Act (PPACA). That law along with the Health Care and Education Reconciliation Act are the basis of health care reform that were signed into law by President Barack Obama on March 23, 2010.

The law REQUIRES people who do not have employer or government health insurance to buy essential health insurance.  It is also know as the “individual mandate.”  Ironically, the phrase never appears in the 2,409 page mandate.  It also puts penalties on employers who do not provide health insurance directed by politicians standards.  “The National Federation of Independent Business (NFIB)—the nation’s largest small-business advocacy organization—has joined the ranks of twenty state attorneys general in a lawsuit attacking the constitutionality of President Obama’s new healthcare law.”  http://news.heartland.org/newspaper-article/national-small-business-organization-joins-lawsuit-against-obamacare

Obama, who claims to be a Constitutional scholar has failed to take note that the law he signed is in defiance of the 10th amendment which grants the enumerated powers to the State, not the Federal Government.  Nearly half of the America States are suing to stop this absurd abuse of power.

Regulation of non-economic activity under the Commerce Clause is possible only through the Necessary and Proper Clause. The Necessary and Proper Clause confers supplemental authority only when the means adopted to accomplish an enumerated power are ‘appropriate’, are ‘plainly adapted to that end’, and are ‘consistent with the letter and spirit of the constitution.’ Requiring citizen-to-citizen subsidy or redistribution is contrary to the foundational assumptions of the constitutional compact. (Case 3:10-cv-00188-HEH, Document 1. If the Federal Government is allowed to make you buy insurance, what else can it make you do? We already know it make you pay taxes, and there in is a precedent for this case.  Could the government make you subscribe to a National ID? A vaccination? A RFID Tag? Mandatory Military or Civil Service? Take your land? Stop you from owning a legal firearm?

Executive Orders require no Congressional approval but have the same legal weight as laws passed by Congress. The President’s source of authority to issue Executive Orders can be found in the Article II, Section 1 of the Constitution which grants the President “executive Power.” Section 3 of Article II further directs the President to “take Care that the Laws be faithfully executed.” To implement or execute the laws of the land, Presidents give direction and guidance to Executive Branch agencies and departments, often in the form of Executive Orders.

After flubbing Obama’s swearing in, in an “abundance of caution,” Chief Justice John G. Roberts, Jr. had once again administered President Barack Obama’s swearing-in as they stood in the Map Room of the White House.

I’m really surprised that anyone was taken in for a moment by Obama and Roberts “flubbing” the oath of office. Obama knows perfectly well that he is not an American citizen and so cannot legally take the oath. This little charade he played out with Roberts was obviously designed to cover up the fraud. Now we know why the Supreme Court refused to hear the birth certificate case — Roberts was in on it from the beginning.

The Supreme Court has failed to hear eligibility cases that would make everything he has ever done, moot.  So now we have to have faith that when the Court issues its ruling, expected sometime in June, that it will put an end to this nonsense.

How can anyone figure out The Heath care Reform Bill when people can’t even figure out the Tax Code?

Republican Rep. Jason Chaffetz, R-Utah, is irked that nearly 100,000 civilian federal employees owe the IRS $962 million in back taxes. He thinks they should pay up or be fired.   Chaffetz has introduced a bill that calls for the federal government to “ferret out” civilian employees who have “seriously delinquent tax debt” and prevent the hiring of other tax delinquents.  More than 3 percent of the 2.8 million federal civilian employees owed the Treasury unpaid federal income taxes in 2008, according to the IRS. Obtained from the GPO- Government Printing Office, as of April 1st 2009, 14,872 pages of tax code.  It is over 24 times longer than the King James version of the Bible at 608 pages. Over 11 times longer than War and Peace by Leo Tolstoy-1296 pages.  It’s 20 volumes are about 5 feet thick! Laying the pages end to end it would be over 2.5 miles  The average reader would take 31 days of non stop reading to read all of the tax codes.

According to the Congressional Budget Office, the House Health Care bill would cost $894 billion over 10 years and extend insurance coverage to 36 million, covering 96 percent of Americans. This morning, Speaker Nancy Pelosi will unveil(ed)  the re-tooled Affordable Health Care for America Act (HR 3962). (Read the bill HERE.) with props to http://wonkroom.thinkprogress.org/2009/10/29/details-house/ who notes that the legislation on the floor next week, with a final vote before “Veterans Day,” November 11th. At the moment, “House Democrats do not have firm commitment from enough lawmakers to guarantee passage of their bill.” One whip count has shown 23 centrist Democrats intend to vote against any health bill. Assuming that all Republicans vote against it, the bill can lose at least 38 Democrats and still pass the chamber.

“(a) Outpatient Hospitals – (1) In General – Section 1833(t)(3)(C)(iv) of the Social Security Act (42 U.S.C. 1395(t)(3)(C)(iv)) is amended – (A) in the first sentence – (i) by inserting “(which is subject to the productivity adjustment described in subclause (II) of such section)” after “1886(b)(3)(B)(iii); and (ii) by inserting “(but not below 0)” after “reduced”; and (B) in the second sentence, by inserting “and which is subject, beginning with 2010 to the productivity adjustment described in section 1886(b)(3)(B)(iii)(II)”.

Adding more wasted taxpayer dollars- the U.S. has spent $1.5 billion for the 250 million swine flu vaccines that the government has ordered so far and will be distributing free to doctors, pharmacies and schools. Congress has left the building and I am going with them.   In my email inbox today a letter from Mitch Stewart, Director Organizing for America:

“All throughout August, our members of Congress are back in town. So is it legal?  The Privacy Act of 1974 courtesy of  Nixon’s Watergate scandal prohibits any federal agency from maintaining records on individuals exercising their right to free speech.

“The White House is in bit of a conundrum because of this privacy statute that prohibits the White House from collecting data and storing it on people who disagree with it,” Judge Andrew Napolitano, a FOX News analyst, said Friday.  “There’s also a statute that requires the White House to retain all communications that it receives. It can’t try to rewrite history by pretending it didn’t receive anything,” he said.

Ah, lest we not forget that America is under a Public Health Emergency thanks to H1N1 Swine Flu, which opens another can of worms that could erode private citizens rights. 

The threat and potential for mandatory mass inoculations and martial law would certainly give the Administration latitude to collect whatever information it deems necessary in the interest of national security.

America, and President Obama’s New World Order is arising faster than anyone thought possible.  In an incredible blink of German Nazi past, the Administration is asking you to report blog and web sites that disagree with Obama’s health care reform.  Taking names, logging IP’s, creating a data base of people’s opinions that are against the elected? Melissa Hathaway, the White House cybersecurity policy advisor resigned yesterday the same day the government asked people to be tattle tales on each other. Report something fishy to the White House?  Prior to this socialised tendency where the government owns the banks and the auto industry, freedom to express one’s opinion was one of those guaranteed pursuit of happiness things along with free speech and the threat of your opinion being policed by Big Brother.

Is it not every Americans duty to express how our government is run and what laws are enacted?    Checks and balances between the executive branch and the legislative branch are not enough.  Speaking on the origins of Swine Flu- that is does not exist in nature but the subject of genetic manipulation,  but equally as compelling, ” You should not fear any reprisal for having done your duty as a citizen.
