BP Oil Spill Two Years Later, Still in Court, Fish Deformed, a New Oil Slick & Obama’s Slick Solutions

April 20, 2010, began with an explosion 40 miles off shore at The Deepwater Horizon oil rig.  Whether you call it the BP oil spill, the Gulf of Mexico oil spill, the BP oil disaster, the Macondo blowout, the Transocean, Halliburton screwup, it was the largest accidental oil spill in the history of the petroleum industry. The explosion killed 11 men working on the platform and injured 17 others.  Most won’t remember the names, only the fact that for three months oil spewed into the Gulf of Mexico creating a huge environmental and economic disaster.  We remember them here- via http://www.usatoday.com/news/nation/2010-05-25-oil-spill-victims-memorial_N.htm

It took until July 15, 2010 to stop the estimated 5 million barrels of crude oil from escaping the gushing wellhead.  What caused it and who was going to pay for it has been lingering ever since.

Unusual pressure readings in the hours before the blowout indicated there was “a very large abnormality” in the well, said a memo released by the House Energy Committee. That suggested that a cement plug, which was supposed to seal off the shaft, had not done so, the memo said.  However, the information was ignored and the drilling crew began removing the drilling mud that was holding back the high-pressure oil and gas. A BP investigator told Congress that the decision was a “fundamental mistake,” according to the memo.

What it comes down to is human error.  Two years later-

BP and a committee representing more than 100,000 plaintiffs have agreed on a blueprint to settle billions of dollars in unresolved economic, property, and medical damage claims….The total cost of the settlement, the company estimates, will reach about $7.8 billion, which makes it one of the largest class-action settlements in U.S. history…The trial has the potential of forcing BP to pay a far greater sum than what was resolved Wednesday. For example, Clean Water Act liabilities could total as much as $17.6 billion….BP has already paid $6 billion to oil spill victims through a $20 billion trust it established last year. If you feel like you may have been damaged, the deadline to file claims under the new resolution is April 22, 2014.  At least the big oil players don’t seem in any danger of running out of money anytime soon.

 The energy giant posted fourth-quarter replacement cost profit of $7.61 billion, up from $4.61 billion during the same period last year.

BP’s annual report for 2010 notes the firm posted a loss of $3.7 billion, largely due to a total charge of $40.9 billion incurred by the Gulf of Mexico oil spill disaster.  But in the fourth quarter of 2010, BP actually pulled in a profit of $4.4 billion dollars, which has prompted the company to pay a small dividend of 7 U.S. cents on the share to its shareholders for the fourth quarter. Halliburton reported net income of $627 million, or 68 cents per share for the first three months of the year. (2012) That compares with $511 million, or 56 cents per share, for the same part of 2011. Revenue increased by 30 percent to $6.87 billion, including a record $4.17 billion in North America.

Shares rose by $1.51, or 4.6 percent, to $34.17.

Halliburton’s results include a $300 million charge related to its role in the 2010 Gulf of Mexico oil spill. The company had provided cementing services for BP PLC on the well that suffered the disastrous blowout. While it continues to spar with BP over who should take responsibility for the disaster, Halliburton said it needs to set aside funds for “probable losses” from future lawsuits and settlements.

BP expects to pay more than $37 billion to cover damages and other costs, and it says Halliburton should pay a share of that. BP has collected several billion dollars from minority owners and other contractors associated with the well. America needs oil, we do not need another incident like this.  While the BP incident resulted in changes to offshore-drilling regulations and increased vigilance about oil spills, The U.S. Coast Guard just last week spotted another oil slick in the Gulf.

What are the odds that 10 miles of an unknown substance wouldn’t be oil from a nearby platform?  Guess there is the off chance a 747 plane dropped its fuel.  Uh, huh. BP used at least 1.9 million gallons of toxic Corexit dispersals to sink the oil. …chemicals named polycyclic aromatic hydrocarbons (PAHs), released from BP’s submerged oil, are likely to blame, due to the fact that the fish with lesions he is finding are from “a wide spatial distribution that is spatially coordinated with oil from the Deepwater Horizon, both surface oil and subsurface oil.

President Obama, who actually managed to visit the area long after Jimmy Buffett did, has managed to come up with the idea that the oil industry does not need tax breaks.  He vetoed the Keystone Pipeline, and has barely issued any new permits for drilling on federal lands.  His most recent thought on how to curb the rising costs of gas?  To spend $52 million on further regulations in the oil futures markets.

Obama wants Congress to strengthen federal supervision of oil markets, increase penalties for market manipulation and empower regulators to increase the amount of money energy traders are required to put behind their transactions. http://www.cbsnews.com/8301-250_162-57415230/obama-calls-on-congress-to-help-police-oil-markets/ The federal gas tax — 18.4 cents a gallon for gasoline, 24.4 cents for diesel.  This year we managed to export more than we imported.  For every mile you don’t drive to burn up gas, the government makes no money and that means no new bridges and infrastructure.

Secretary of the Interior Ken Salazar, during a visit to the Fort Berthold Reservation Tuesday, unveiled initiatives to speed up drilling permits and leases on federal lands.

Salazar announced the Bureau of Land Management, an agency of the Interior Department, will implement new automated tracking systems that could reduce the review period for drilling permits by two-thirds and expedite the sale and processing of federal oil and gas leases.

By May of 2013? That’s 13 months from now!  Ridiculous. All the hoops and regulations seem to be online now at the BLM website including a free download of the publication Surface Operating Standards and Guidelines for Oil and Gas Exploration and Development (commonly referred to as The Gold Book) was developed to assist operators by providing information on the requirements for obtaining permit approval and conducting environmentally responsible oil and gas operations on Federal lands and on private surface over Federal minerals (split-estate).

Not to be all doom and gloomy, there is a bit of good news.

Oil in New York has technical support along its 100-day moving average, around $101.93 a barrel today, according to data compiled by Bloomberg. Futures have been trading above this indicator for the past week. Buy orders tend to be clustered near chart-support levels.

U.S. crude stockpiles climbed to 369 million barrels, the highest level since May 27, the Energy Department data showed. When is BP, the Obama Administration and the Main Stream Media going to get their heads out of the rabbit hole?  They can’t.  Not only is the hole is filled with black oil, deceit, distortion and outright lies. Alice in Wonderland, and all her little friends would be dead were the hole in the Gulf of Mexico.

Albert Einstein said, “After Hydrogen, Stupidity is the most common element in the Universe.”  He sure hit the nail on the head. 

Does the media, politicians and BP think Americans are stupid?  Yep, and there is a whole bunch of stupidity to go around, starting with the people who voted for Obama.  That aside, events at the Deepwater Horizon Oil Spill are a mess.

In May, BP CEO Tony Hayward said the spill was “relatively tiny”,  and the environmental effects would be minimal.

Since the Deepwater Horizon oil rig exploded and sank April 20, BP has estimated 5,000 barrels of oil were flowing from the underwater well into the Gulf. Independent scientists believe the crude oil is spewing more like 95,000 barrels a day.

They have syphoned it, capped it, top killed it, sprayed the dispersal COREXIT at it, lit it on fire, junk shot it and in the last malady, capped it again claiming that their is no oil leaking. 

Paul “Red” Adair, the now deceased famous oil firefighter must be rolling in his grave at this epic madness.  Enter Pat Campell, Adairs’ colleague who has now been employed by BP to cap the well beneath the ruined Deepwater Horizon oil rig. 

These days, Campbell says that disaster relief has become a more collegiate affair. He also told The New York Times that helping BP cap Deepwater Horizon involves dealing with meddling managers and politicians. “Today things are done by committees. The executive management gets involved. Well it sure has not worked out fine.  Matt Simmons says BP covering up MASSIVE HOLE miles away, and the cap test is “absurd.”

Back to the COREXIT for a minute.  

The Taiwanese super oil skimmer known as “A Whale” has been deemed ineffective by the US Coast Guard. It sucked up only negligible amounts of oil during its test run in the Gulf.  Maybe, just maybe it’s because the Corexit worked?  The EPA/FDA food tests say it is not showing up in fish, clams, oysters etc.

Is COREXIT Oil Dispersant Eating Through Boats in the Gulf?

Another of  The Deepwater Horizon disaster hearings was canceled today in New Orleans, LA after previous day’s testimony provides little insight.

Though the hearings are public, they aren’t entirely transparent. Much of the discussion involves documents that aren’t being released in real time. The coded message in a nutshell is that we are screwed, no matter the blame or malfeasance.

A blogger has noticed that the oil giant altered a photograph of its Houston crisis room, cutting and pasting three underwater images into a wall of video feeds from remotely operated undersea vehicles. The altered photo is displayed prominently on the company’s Web site.

John Aravosis pointed out the alterations Monday evening on his Americablog.com and observed, “I guess if you’re doing fake crisis response, you might as well fake a photo of the crisis response center.” The photo doctoring comes as BP has promised transparency in a bid to regain the public’s trust.

Now come on- stupid is as stupid does!

Nothing will stop the Obama agenda though.  With a moratorium on off shore drilling and now him pushing a no coal agenda, someone want to tell me how the U.S. is going to meet it’s power and fuel needs?

GULF OF MEXICO OIL SPILL AND AFFECTED COASTLINE CLOSED

The media blackout continues.  The airspace over the coastal waters around the Deepwater Horizon Oil Spill have been closed by the FAA. 

Pursuant to 14 CFR section 91.137(a)(1) temporary flight restrictions are in effect for deepwater horizon/mississippi canyon (mc252) incident cleanup and reconstitution operations…All aircraft operations are prohibited except those flights authorized by ATC, routine flights supporting offshore oil operations; federal, state, local and military flight operations supporting oil spill recovery and reconstitution efforts; and air medical and law enforcement operations. http://tfr.faa.gov/save_pages/detail_0_5100.html 

The closing of airspace does occur from time to time for everything from a military air show, to the arrival of a VIP.  Other recent airspace closures can be found at http://tfr.faa.gov/tfr2/list.html.  Most recently, much of Europe airspace was closed and blamed on the often invisible ash cloud from the Iceland Volcano.  We saw airspace closed in the entire U.S. immediately after the events of 9-11.

So why close the airspace over an oil spill? 

We know the oil spill is huge, and we know that BP and the AirForce is spraying COREXIT, the dispersant.  The release says, “For additional information on air operations within the deepwater horizon TFR see website: https://1afnorth.Region1.Ang.Af.Mil/deepwater_spill/default.Aspx This link is a military site that offers no public access.  So much for taking a little plane ride over the area.

April 30, 2010. WASHINGTON (AP) — Two Air Force planes have been sent to Mississippi and were awaiting orders to start dumping chemicals on the oil spill threatening the coast, as the government worked Friday to determine how large a role the military should play in the cleanup.

While we no longer have Posse Comitatus anymore with active U.S. Military Troops on U.S. soil, we now have BP hiring private security contractors to protect the oil spill, cleanup efforts and keep onlookers away.

Even Anderson Cooper of CNN,  was warned by FEDERAL WILDLIFE OFFICIALS to avoid doing a bird clean up interview and when pursuing images of the clean up area, was denied access by a NATIONAL GUARD Troops. 
 
 
Now we have the National Guard, The FAA, and private contractors all denying access.  Who and what authorizes BP, and a mercenary security firm like Talon Security to have the right to provide security in the Gulf in the first place?  Should privatized corporate law enforcement be a surprise.

Should the federal government demand and regulate all oil employees who work on the oil rigs?  Should the federal government provide security on and around oil production rigs? On May 5th, 2010, “Taylor flew over the spill in a Coast Guard plane on Saturday and said it was “not as bad” in an interview with a Biloxi TV station. Chocolate milk does not require the coast guard, AirForce, private security personnel and closed airspace.  Relying only on BP data is BS.  BP appears to have control over Nat’l Incident Mngt Systems data.

What this means to the non-GIS layperson:

1) The current configuration and process allow BP to limit or slow down the flow of information about the extent of the disaster to the government, the public and law enforcement, which I believe is against the spirit and letter of NIMS*.

2) The current process allows BP to treat GIS datasets as proprietary information. It is my understanding that public agencies, like The US Fish and Wildlife Service and The Louisiana National Guard, are literally submitting the only copy of agency field data directly to a BP GIS server behind the corporate firewall. Examples of these data are; dead bird and fish locations with photos, boom deployment and engineered construction, dates, along with other descriptive information and photos.

3) The GIS information is essential to the recovery of public resources, and some data belongs to US taxpayers, not BP. BP is paying for the hardware and collection of these GIS datasets, yet it is my understanding that the data belong to the people of the United States. BP must not be allowed to protect these data as if they were a proprietary product.

4) State Emergency Operation Center staff, Parish EOC staff, and other Emergency Responders and Recovery Specialists do not have access to these GIS datasets, contrary to all NIMS guidance, protocols and principles. The effort to slow down the flow of information is at the expense of the containment and cleanup effort of the responders and is in our opinion, suspect behavior by BP.

5) The Federal On Scene Coordinator at ICP Houma, US Coast Guard Captain Ed Stanton, standing with USCG Rear Admiral James Watson, approved the National Incident Management System (NIMS) compliant design, and ordered the first database and server. That server was received by BP, and placed behind the BP firewall.

Conclusion–At the very least, per NIMS, there must be redundancy of GIS information managed jointly, and fully accessible to both the FOSC and the SOSC. Technology allows implementation of this design to occur instantaneously and automatically. http://www.theoildrum.com/node/6593

President Barack Obama declared war on the Gulf Oil spill in his first nationally televised address from the Oval Office.  Obama wagged a finger in emphasis and insisted that oil giant BP will pay for the extensive environmental and the economic damage to the Gulf region. Duration: :01:32.

What is more toxic, the oil spill or President Obama politics?  

The real goal of “health care” legislation, the real goal of “cap-and-trade,” and the real goal of the “stimulus” is to rip the guts out of our private economy and transfer wide swaths of it over to the government to control. Former FEMA director Michael Brown is not backing off his charge that the Obama administration wants to use the Gulf Coast oil spill as a plot to put an end to offshore drilling.   “They want a crisis like this, so that they can use a crisis like this to shut down offshore and gas drilling,” he said Tuesday night on CNN’s “AC 360°.”    

The San Francisco Chronicle in January 2008. Obama told the Chronicle editorial board that he wanted cap-and-trade legislation to be as strong as possible.    

“So if somebody wants to build a coal-powered plant, they can. The Deepwater Horizon isn’t the only oil leaking into the Gulf of Mexico.  For the last for the last six years another underwater platform has been leaking– 

Site owner Taylor Energy Co. LLC said in a written statement that a production platform about 70 miles southwest of the Deepwater Horizon disaster was collapsed during Hurricane Ivan in 2004 by an underwater mudslide.

Goldman Sachs analysts cut their view on the deepwater drillers to neutral specifically, the firm downgraded Diamond Offshore, Atwood Oceanics Inc., Noble Corp. and Transocean Ltd. No stock value means no one drills for oil and we either import it or go without to meet the nation’s energy needs.

Hurricane season officially begins today, and not a moment too soon with a tropical storm brewing in the Gulf of Mexico.

Tropical Storm Agatha swept across Central America yesterday, bringing torrential rain that killed more than 100 people and opened a 60m-deep sinkhole in Guatemala City which reportedly swallowed up a three-storey building. The first named storm of the 2010 Pacific season dumped more than a metre of rain in parts of Guatemala, also hitting El Salvador and Honduras. On the May 28 edition of Premiere Radio Networks’ The Rush Limbaugh Show, el Rushbo eluded that the oil spill could intensify hurricanes. Media Matters http://mediamatters.org/mmtv/201005280034  has the soundbite, and at least one commentator-Gravity_78  agrees saying that:

Water (H2O) losses about 2F for every 100 ft, Sea Water losses about 1.4 F for every 100 ft. Oil on the other hand heats up under pressure, so the great the pressure the hotter the oil will be. In turn the oil could heat the waters around it by as much as 5 F, and that would be bad. Hot water is what drives a hurricane, the hotter the water the stronger the hurricane.

A perfectly round sinkhole and a perfectly round Tropical Storm?  Perfect crap.  Here is some more bull:

Well that’s just phooey.  No one was ready for the damage being caused by the oil spill in the Gulf- not BP, Transocean, Halliburton and especially no one in the government including the woman that either got fired or resigned, was in control.  What was it Obama said?  I’ve been in charge since day one.  If you believe New Orleans can handle another Katrina, I have a nice island for sale for a buck in the Mariana Islands.  If you don’t beleive in weather modification:

This Saturday, there was a supposed an under water volcanic eruption near the Pacific’s Northern Marianas Island , 3,800 miles southwest of Hawaii that shot clouds of ash and vapor nearly eight miles into the sky. That’s 40,000 feet ladies and gents.  The U.S. Geological Survey says Saturday morning’s eruption appeared to come from an underwater volcano off Sarigan, an uninhabited island about 100 miles north of the U.S. commonwealth’s main island of Saipan.  No satellite images for that mystery event.

The Weather Service statement says that on Saturday night about 10:30pm,  the residents of Sarigan reported an eruption south of their island. The Deepwater Horizon Spill in the Gulf Coast has become a cluster cluck.  President Obama, a month after the leak started has decided that we now need a special commission headed by Ken Salazar, while Lisa P. The oil continues to flow, although BP is allegedly siphoning off some of the oil underground.   BP claims 5,000 gallons per day since April 13 and finally a month later on May 20, it has been decided that the federal government will come up with its own determination of how much oil is gushing in the Gulf.  Perhaps it should take its own water samples too.

The EPA gave BP it’s okay to use chemical dispersants in an effort to corral and degrade some of the oil last week.  By Thursday, the EPA issued a directive for BP to stop using the controversial Corexit dispersal chemical within 24 hours.   https://ahrcanum.wordpress.com/2010/05/21/dispersants-epa-stops–  

BP’s response was a pungent reminder of who is in charge, and it most certainly is not the EPA or and branch of the government.  BP issued a terse reply, saying it would continue to use the controversial chemical Corexit despite the directive.  BP officials believe that the leading alternative product, Sea Brat could pose a bigger risk over the long term.

Democratic strategist James Carville and MSNBC anchor Chris Matthews, two reliable supporters of President Barack Obama, have issued withering critiques of the administration’s handling of the Gulf oil spill.  Carville, the famously outspoken Louisianian who was a chief political aide to Bill and Hillary Clinton, told CNN’s Anderson Cooper on Thursday that the administration’s response to the spill has been “lackadaisical” and that Obama was “naive” to trust BP to manage the massive clean-up effort. Oversight by Federal Agencies- how laughable. Really, what’s one more law or promise broken by the government?

BP chief Tony Hayward told the Associated Foreign Press, “everything we can see at the moment suggests that the overall environmental impact will be very, very modest.”

By comparison, the death count of sea critters so far seems small.  With nearly 20% of the Gulf closed to fishing, a fish kill would most likely never be documented in the open waters, only what is witnessed on shore.
It doesn’t just take a cold snap or an oil spill to close beaches.  How about a birds nest?   A shorebird called a tern laid a single egg in Cape Hatteras National Seashore.  The result:

The Deepwater Horizon Oil spill or leak as BP calls it, is a disaster of epic proportion.  The response by the EPA is equally to blame in the approval of two chemical dispersants by BP, and it’s reliance soley on BP to clean it up and provide water samples.

Saturday May 15, 2010-“Based on the scientific analysis of the EPA and NOAA and review by the National Response Team, it has been determined that the use of dispersants at the subsea source is the prudent and responsible action to take along with other tactics including surface dispersant, skimming and controlled burns.” http://www.deepwaterhorizonresponse.com/go/doc/2931/551271/

COREXIT products clearly state that they are not to be used on surface water and are toxic to wildlife. And that, “It is unknown if dispersed oil has toxic implications to the human population because bioaccumulation through the food chain has not been evaluated.”  http://www.epa.gov/bpspill/dispersants.html#q3 

It was not prudent and responsible to approve these particular products, and now in a reverse course, EPA is revoking its decision.

The Environmental Protection Agency informed BP officials late Wednesday that the company has 24 hours to choose a less-toxic form of chemical dispersants to break up its oil spill in the Gulf of Mexico, according to government sources familiar with the decision, and must apply the new form of dispersants within 72 hours of submitting the list of alternatives.

The move is significant, because it suggests federal officials are now concerned that the unprecedented use of chemical dispersants could pose a significant threat to the Gulf of Mexico’s marine life. Keeping in good graces in the eye of  the government and the public, Nalco issued this statement on EPA Analysis of Sub-surface Dispersant Use,  http://phx.corporate-ir.net/phoenix.zhtml?c=182822&p=irol-newsArticle_pf&ID=1429558&highlight=NAPERVILLE, Ill.,

May 20, 2010 (GlobeNewswire via COMTEX) –Nalco (NYSE:NLC) today issued the following statement:We are gratified that the EPA has acknowledged that the use of Nalco’s dispersants has been effective and has had no undue impact on the marine environment.  As the agency noted on its website today: “Toxicity data does not indicate any significant affects on aquatic life. Moreover, decreased size of the oil droplets is a good indication that, so far, the dispersant is effective.”

The results can be found at http://www.epa.gov/bpspill/ .  To date, approximately 600,000 gallons of dispersant has been used on the surface and approximately 55,000 gallons of dispersant has been used subsurface, at the source of the spill. 

Do you smell something fishy?

Nalco claims the products are working just fine with no hazards, yet the EPA is revoking the use of COREXIT?  Yep.  It boils down to the fact that the government is not happy with BP.  In a Letter From Secretary Napolitano and EPA Administrator Jackson to BP CEO Tony Hayward (PDF) they all but accuse BP of adulterating water samples to justify that COREXIT and the sucking up gadget is having a positive effect of the spill.

Friday, May 21, 2010 11 a.m. CDT. U.S. Coast Guard Incident Commander Capt. Steven Poulin, U.S. Coast Guard Deputy Incident Commander Capt. Bill Drelling, and BP Incident Commander Keith Seilham of  The Deepwater Horizon Response Unified Incident Command, Mobile, Ala., are scheduled to hold a press briefing about ongoing response operations along the Mississippi, Alabama and Florida coasts.  http://www.deepwaterhorizonresponse.com/go/doc/2931/557791/  I got tired of listening to the music and hung up after the delayed start, but why wouldn’t the EPA be involved as well?

Salazar implies BP and other oil companies want to lose untold amounts of oil and money on purpose.  Gives you that warm fuzzy feeling that more independence will prevent this from happening again.  How about a new set of federal reforms that secure our border?

The Bp Deepwater Horizon Oil spill continues with no end in sight. 

The NOAA branch of the government called OFFICE OF RESPONSE AND RESTORATION, EMERGENCY RESPONSE DIVISION worked on a Saturday, May 15, 2010 to issue a report called DEEPWATER HORIZON OIL: CHARATERISTICS AND CONCERNS,  http://www.deepwaterhorizonresponse.com/posted/2931/OilCharacteristics.551475.pdf

The report tells us that oil in water is hazardous to human and aquatic life and makes some suggestions on how to clean it up.  Gee thanks, our tax dollars at work as if we didn’t know it was a hazard. 

Also on May 15, 2010, The U.S. Coast Guard and U.S. Environmental Protection Agency (EPA) today announced they have authorized BP to use dispersants underwater, at the source of the Deepwater Horizon leak.  Oil spill dispersants are chemicals that attempt to break down the oil into small drops and prevent it from reaching the surface or the U.S. shoreline.  Dispersants are generally less harmful than the highly toxic oil leaking from the source and they biodegrade in a much shorter time span.

“Based on the scientific analysis of the EPA and NOAA and review by the National Response Team, it has been determined that the use of dispersants at the subsea source is the prudent and responsible action to take along with other tactics including surface dispersant, skimming and controlled burns.” http://www.deepwaterhorizonresponse.com/go/doc/2931/551271/

Prudent and Responsible?  Calling it a novel approach,  the government is relying on BP to use chemical dispersants among other clean up efforts.  The two approved products are COREXIT EC 9500 A http://www.deepwaterhorizonresponse.com/posted/2931/Corexit_EC9500A_MSDS.539287.pdf and COREXIT 9527  C  http://www.deepwaterhorizonresponse.com/posted/2931/Corexit_EC9527A_MSDS.539295.pdf Both are manufactured by Nalco Company, Illinois. http://www.nalco.com/

WARNING!  NOT TO BE USED ON SURFACE WATER. Oh so what, the EPA  has given its approval to use them on the surface and underwater.  The ecotoxicological effects on fish, had them dead within 48 – 96 hours.  If the oil doesn’t kill the Gulf of Mexico’s fish, the chemical dispersants likely will.  If they do live, who wants to eat them?   Dr. Jane Lubchenco the  Undersecretary of Commerce for Oceans and Atmosphere, NOAA, says she’ll eat them, saying, “Yes, and I would enjoy it.”

 It is unknown if dispersed oil has toxic implications to the human population because bioaccumulation through the food chain has not been evaluated.  http://www.epa.gov/bpspill/dispersants.html#q3

Did BP ask, or did the EPA order the use of dispersals?  On May 10 the EPA asked BP to implement a Dispersed Plume Characterization Plan for Subsurface Dispersant Application.  http://www.epa.gov/bpspill/dispersants/subsurface-dispersant-directive-final.pdf  This plan relies soley on BP to do the testing and then sending the results to the EPA.   How much could it cost for the Coast Guard to do some some of it’s own testing to keep BP honest?  What happens if BP doesn’t execute the plan at all? 

Officials monitoring the subsea results reported that the first two tests were inconclusive. Logistical problems in obtaining samples down to 5,000 feet prevented proper sampling. A third test is underway, with some samples already in the labs at Louisiana State University reports Global Research. http://globalresearch.ca/index.php?context=va&aid=19151

Imagine that.  The results are inconclusive.  I conclude, a dead fish can’t swim upstream.
