Pandemic Influenza Quarantine, Navy Intel

The Department of The Navy under the Department of Defense command, Pandemic Influenza Policy is now available for your perusal.  While we can not confirm it’s authenticity, there is a signature from Sam J. The Navy Website tracking the flu for Navy personnel is located at http://www.nmcphc.med.navy.mil/downloads/prevmed/NDRSiReportingUpdate_14Sept09.pdf.  The Navy is battle ready, with only a few reported cases of the flu.

All in all, the H1N1 Swine Influenza appears to be mild.  We pray it is a fear pandemic, rather than a deadly one requiring military intervention that is excerpted here from the Navy report:

movement restrictions are essential for a successful containment

H1N1 Swine Flu Quarantine Legal in USA

With a supposed second wave of the H1N1 Swine Flu projected to hit thousands of citizens in the U.S., states are busy setting up new laws for quarantine and restraint even though the CDC has stated that Swine Flu symptoms for the most part, are no worse than the seasonal flu . In April of 2009, http://www.cbsnews.com/blogs/2009/04/28/politics/politicalhotsheet/entry4975598.shtml reported that is was The Department of Justice that has the established legal federal authority pertaining to the implementation of a quarantine and enforcement of quarantines of U.S. Citizens. Under approval from Health and Human Services, the authority to issue quarantines goes to the U.S. Surgeon General. http://www.surgeongeneral.gov/

The acting Surgeon General since October 2007 is Rear Admiral Steven K. Galson, M.D., M.P.H. http://www.surgeongeneral.gov/about/biographies/biosg.html While President Obama has been busy skirting constitutional law in the appointment of Czars, The United States has had no official Surgeon General for two years.

With the power to render millions of U.S. Citizens into quarantine, would the power then not be reserved for the President Obama himself? So who, and what laws allow for quarantine of individuals?

President Bush added “novel” forms of influenza with the potential to create pandemics in Executive Order 13375 outlined here. http://edocket.access.gpo.gov/2005/pdf/05-6907.pdf The document says- ‘‘(c) Influenza caused by novel or reemergent influenza viruses that are causing, or have the potential to cause, a pandemic.’’

Anyone violating a quarantine order can be punished by a $250,000 fine and a one year prison term.

Four years ago in November of 2005, The Bush administration released the National Strategy for Pandemic Influenza providing an outline for coordination among federal agencies, the stockpiling and distribution of vaccines and anti-viral drugs, and, if necessary, government-imposed quarantines and limitations on gatherings. This report compiled by the Congressional Research Service provides a comprehensive overview of federal and state public health laws, specifically those that relate to the quarantine of individuals. Additionally, the report undertakes discussion of constitutional issues and questions concerning individual liberties that are raised in a quarantine situation. Federal and State Quarantine and Isolation Authority-

Under section 361 of the Public Health Service (PHS) Act, 42 U.S.C. § 264, the Secretary of Health and Human Services (HHS) has the authority to make and enforce regulations necessary “to prevent the introduction, transmission, or spread of communicable diseases from foreign countries into the States or possessions. The PHS Act and related statutes also authorize measures to aid or enforce a quarantine in the event of a public health emergency

The Model State Emergency Health Powers Act (the Model Act) provides a comprehensive framework for state emergency health powers, including statutory authority for quarantine 62 and isolation.63 Section 604 of the Model Act authorizes the quarantine or isolation of an individual or groups of individuals during a public health emergency

Federal quarantine authority derives from the Commerce Clause, which states that Congress shall have the power “(t)o regulate Commerce with foreign Nations,and among the several States

The President could use the Insurrection Act, now titled “Enforcement of the Laws to Restore Public Order,” to enforce health measures in the event that civil officials were overwhelmed during a pandemic and unable to enforce those laws

The Posse Comitatus Act does not apply to the National Guard unless it is employed in federal service as a reserve force of the armed forces. If the National Guard is called up to enforce U.S. laws, however, it is not subject to the Posse Comitatus Act.

The PHS Act, Model Act, Posse Comitatus Act and the Insurrection Act are on the legal books in part, to provide a means of quarantine. From Massachusetts’s attempt to fully amend its quarantine laws, new laws are in conference to enhance government authority and reduce your individual freedoms.

In the first known official quarantine in the U.S – A federal prison in Memphis has been quarantined because of an outbreak of Swine Flu. United States Attorney Lawrence J. Laurenzi says in the document, prisoners are not allowed to leave FCI Memphis for court appearances because of the quarantine. Prison officials have not released any information about the situation at this time.

Obama’s Health Care Reform Bill Goes on Tour

President Obama is scheduled to return to the United Sinking States of America sometime today after yet another standing room only rock star tour.   In six days, he traveled to Saudi Arabia, Egypt, Germany and France.  He delivered the kind eloquent speeches that GW could nary do, not fumbling a word; but filled with contextual imperfections that leave many nations reading between the lines as to his intentions.  In reviewing Obama’s quotes from the tour, Firedog Lake asks, “Is it me, or is awaiting Obama’s follow-through a bit like standing in front of a slot machine wondering if a payoff will actually come.” http://oxdown.firedoglake.com/diary/5644 

This tour paid off with some family time in Paris where Obama lit a candle and listened to a children’s choir in the 12th century Notre Dame cathedral.  Awww, how nice!  Not only does he have honorary degree from Notre Dame University, but what a privilege to be in a church where no one at the pulpit says, ” God Damn America.”  Surely, he would rather have been at the Springsteen show for the Working On A Dream tour that was playing in Stockholm.  http://www.backstreets.com/news.html 

Obama will be begin his next tour with his political group Organizing for America with his return to the United Sinking States of America today.  This  public relations tour looks to again remove the rights of individual states and citizens, and increase reliance on the federal government.

In conquering the banking and auto industry, the health care industry is next on the socialistic agenda. In the weekly blog at http://www.whitehouse.gov/the_press_office/WEEKLY-ADDRESS-President-Obama-Outlines-Goals-for-Health-Care-Reform/  Obama said, “We must attack the root causes of skyrocketing health care costs.  Some of these costs are the result of unwarranted profiteering that has no place in our health care system.”  When did profit become so wrong in capitalism? 

“After months of insisting he would leave the details to Congress, President Obama has concluded that he must exert greater control over the health care debate and is preparing an intense push for legislation that will include speeches, town-hall-style meetings and much deeper engagement with lawmakers, senior White House officials say.” http://www.nytimes.com/2009/06/07/us/politics/07policy.html?_r=1&hp  “Obviously,” Mr. Emanuel said, “the president’s adoption of something makes it easier to vote for, because he’s — let’s be honest — popular, and the public trusts him.”

Tickets for the trust Obama tour aren’t cheap.  From The Daily Pfennig, a daily email newsletter from Everbank https://www.everbank.com/  so far have cost , “Your family’s share of the government debt is now over half a million dollars. A record $546,668, to be exact. That cheery Monday stat comes courtesy of a USA Today study, which claims that each American family’s share rose 12% in 2008. That’s $55,000 in new government debt last year for every US household – thousands more than the median household annual income. ”  Add in the bailouts of 2009 and if health care is expensive now, just wait until we see the ticket price when the government takes over. 

The ticket cost for freedom is priceless.  The ticket price for the Obama Administration plan to change the world and America’s health care; to be determined later, in full transparency of course.
