Change you can believe in?

H. J. Res. 5 http://www.govtrack.us/congress/bill.xpd?bill=hj111-5  is a proposed amendment to repeal the term limits for presidents and introduced Jan.6, 2009 by Democrat Serrano.    http://serrano.house.gov/Biography.aspx  U.S. Representative José E. Serrano represents the 16th Congressional District of New York – the Bronx.  He is the only Congressman from New York City on the exclusive House Appropriations Committee and is serves as Chairman of the Subcommittee on Financial Services and General Government.

From his bio, “Serrano believes that government should work to ensure that the prosperity of our country is shared by the neediest and most vulnerable members of our society- the poor, the elderly, the disabled, and children- in the form of participation in government, educational opportunities, access to housing and affordable health care. ”

Golly Gee, sounds just like socialistic rhetoric from Obama.   More participation in government?  Howza bout enforcing laws on the books?  Laws that would have alleviated the disastrous economic declines of Freddie, Fannie, etc.?  Laws that were already in place to prevent the Madoff ponzi?  Laws that discourage capitalism and instead form a reliance on the government to solve the individual woes?  Honest effort and pride in accomplishment used to be a winning formula.

At a time in this country when we have an incoming president who has faulted the Constitution more than once,  here we have an elected official with a significant amount of clout introducing on the first day of Congress a bill to change our Constitution and allow for a President to serve pretty much without time limits, “Proposing an amendment to the Constitution of the United States to repeal the twenty-second article of amendment, thereby removing the limitation on the number of terms an individual may serve as President.”

He also introduced a total of 16 other Resolutions – http://thomas.loc.gov/cgi-bin/bdquery/R?d111:FLD003:@1(rep%20serrano): from ending the trade embargo with Cuba, allowing Cuban baseball players waivers to play professional baseball in the US, to changes title XIX of the Social Security Act, to something he coins as the “English Plus Resolution”-H.CON.RES.3   English Plus has emerged as the main policy alternative and rallying cry for those opposed to the English Only campaign. http://ourworld.compuserve.com/homepages/JWCRAWFORD/engplus.htm Back in 2001, Serrano introduced HCON 9 IH, http://ourworld.compuserve.com/homepages/JWCRAWFORD/HCR9.htm s similar measure that would seemingly mandate a foreign language.  It was not passed.

“English Plus” resolutions have been passed in the U.S. states of New Mexico, Oregon, Rhode Island, and Washington.  Ironically, English Plus has not been passed in the Congressman’s home state of New York.  I wonder what language would be proposed?  Arabic? Mandarin?  Any of the countries who might be perceived as a military threat?

For heaven’s sake if he wants to remove a language barrier, how about starting with educating the military.  Imagine these poor soldiers in Afghanistan and Iraq who were never trained in a fundamental intelligence operation like being able to speak the enemy language.  “I surrender, What? What did you say? Oh, you’ve got a gun, bang.”

We have American combat troops stationed right here on our soil, and I am pretty happy that they speak English and able to defend us.  In fact, I wish there were more protecting our borders.

The leader of the free world, President Obama clearly views the Constitution as an obstacle to “political and economic justice in this society.”   The Constitution has served Mr. Obama well, and rather conveniently somehow allowed him to avoid providing proof that he meets the requirements of the natural-born citizen clause, Article II, Section 1, for eligibility as President.   Every case to date and under the interpreted laws of the land, all the way up to the Supreme Court, he has avoided providing any documentation of his birth.

The Constitution and law has been circumnavigated more than once by Presidents.  Minuscule on the scale are little Orders like-” All executive branch departments and agencies of the Federal Government shall be closed and their employees excused from duty on Friday, December 26, 2008, the day after Christmas Day”  http://www.whitehouse.gov/news/releases/2008/12/20081212-2.html to some pretty hefty changes in a Presidents authority can be found here  http://www.whitehouse.gov/news/orders/.  I wonder if our tax dollars paid them for the day off?

In tracking the Obama Presidency, apparently BHO is going to repeal some of them including an attempt to close Gitmo.  http://content.usatoday.com/communities/theoval/post/2009/01/61265288/1

We had all better become better informed as to what our elected officials are doing, what laws they are proposing, and what laws they choose to enforce.  We can’t rely on MSM and let’s face it, often times watching C-SPAN is like watching paint dry.  Whatever language we speak, everyone here in America, even the illegals get certain rights afforded to them. It is everyones right, privilege and obligation to see that things aren’t just snuck through the cracks when it becomes convenient.

The Constitution was designed for America.  It is your Constitution-  our Constitution, yet today multilateral institutions like the World Bank and International Monetary Fund are privatizing economies and restructuring the social policies of  the world- including America and certainly influencing our Constitutional law.

Our Constitution should not be bent or amended so much so, that we are lost in the New World Order we hear so often about.  Our Constitution should not be amended to allow for a President to serve indefinitely, even if he is “The One,” his campaign promise stood on.

Press 1 for English, press 2…..

God Bless America.

The U.S. Constitution has apparently been suspended in parts of America in an effort to protect its borders from everything from illegal immigration to terrorists.  Rightful to protect its border, except that the border has been seemingly redefined to include a 100 mile wide strip that goes around the entire “external boundary” of the entire United States.

“The extraordinary authority that the U.S. government possesses at its borders is spilling into regular American streets, affecting large populations of its citizens. Nearly two-thirds of the entire population of the country now lives within 100 miles of the U.S. land and coastal borders, an area that has been designated by the government as a “Constitution Free Zone”.  http://www.naturalnews.com/024734.html  and posted similarly at  http://www.dailykos.com/story/2008/10/22/163652/37/734/638977

Could all liberties are put aside if you are rightly or wrongly id’s as having done something wrong?  Would there will be no guarantee of The Bill of Rights protection, no referring to case law and no lawyers to argue on your behalf?

The ACLU lays claim that “Border Patrol agents are not remaining confined to a border security purpose.”  http://www.aclu.org/privacy/37293res20081022.html and it’s blog http://blog.aclu.org/?s=constitution+free+zone says that “U.S. Customs and Border Protection (CBP) is allowed to exercise extraordinary authority that would not normally be permitted under the Constitution.

(ATS) traveler risk assessment program, identity and tracking systems such as electronic (RFID) passports, the Western Hemisphere Travel Initiative (WHTI),  Secure Border Initiative Network (SBINet) or “virtual border fence” and unmanned aerial vehicles (aka “drone aircraft”) all monitor movement.

The Department of Homeland Security is in itself, necessary.  Agents of the FBI, CIA, NSA must cooperate to protect the homeland, but using the word ‘homeland’ outside of a historical discussion of Germany has allowed law enforcement authorities access to broad powers and is just a creepy reminder of Gestapo tactics.  To assume an abuse of power is fear mongering, but fair minded caution must be exercised.  The Patriot Act, Military Commissions Act, and FISA-Protect America Act were enacted post 9-11 for good reason and have been tweaked numerous times to keep America Safe with as little intrusion as possible.

It becomes paramount that we question how secure the technology is in foreign countries and in our own country.  http://electronicintifada.net/v2/article9930.shtml  The Shadow Factory: The Ultra-Secret NSA from 9/11 to the Eavesdropping on America author James Bamford writes about how spying on American citizens has been outsourced to companies closely linked to Israel’s intelligence services. “With unrivaled access to sources and documents, Bamford details how the agency has conducted domestic surveillance without court approval, and he frames it in the context of the NSA’s ongoing hunt for information about today’s elusive enemies. http://www.amazon.com/Shadow-Factory-Ultra-Secret-Eavesdropping-America/dp/0385521324

The Department of Homeland Security “claims that data gathered for law enforcement purposes will be “in compliance with privacy and civil liberties laws and policies of the United States,” the GAO found that “by broadly sharing information with non-federal users, who are not bound by the Privacy Act, personal information could be at risk of being used in ways not specified when it was originally collected.” Considering that some 70% of U.S. intelligence assets are employees of private security and defense contractors, NAO is a civil liberties disaster waiting to happen.” http://www.globalresearch.ca/index.php?context=viewArticle&code=BUR20081109&articleId=10864

The far side would have us believe that we have a ruling oligarchy that professes an agenda of militarism, corporatism, and socialism that encroaches itself upon citizens at the expense of the general population with more domestic control and intimidation.  Maybe the far isn’t so far off? Obama has proposed a mandatory civilian force http://www.rightpundits.com/?p=2318 with equal funding to the military which is already on active duty on our soil http://www.armytimes.com/news/2008/09/army_homeland_090708w/, Charles Rangle has a Draft Bill just lying in wait http://www.talkleft.com/story/2006/11/19/152217/04  , “The Bailout” has the government owning banks and Obama’s policies in waiting have been compared to Marxism. http://louisproyect.wordpress.com/2008/10/01/are-bailouts-marxist/

For now, we will wait to see what decisions Obama makes to shield our country from danger and protect her citizens.  “Let’s be clear here and shed whatever illusions one may have about the outcome of last Tuesday’s election. Despite the overwhelming rejection of the Bush administration and their surrogates by the American people, the incoming Obama administration will pay lip-service to civil liberties and the rule of law. This however, will amount to no more than a better public relations campaign, image management and product roll-out. America rebranded.” wrote Tom Burghardt  http://www.globalresearch.ca/index.php?context=viewArticle&code=BUR20081109&articleId=10864  His blog can be found at http://antifascist-calling.blogspot.com/

For now though our Bill of Rights are safe.  In an all too plausible court case, The Supreme Court in a 5-4 decision narrowly “ruled to uphold the Bill of Rights, the very tenets upon which American society is based. “After carefully considering the relevance of the 10 inviolable rights that comprise the ideological foundation on which our nation is built, the court finds that these basic freedoms remain important for the time being, and should not be overturned,” read the majority opinion authored by Justice Anthony Kennedy, who cast the tie-breaking vote. “Until such time as it can be definitively proven that citizens no longer require the protections provided by the Bill of Rights, it shall remain the principal legal guidance for the United States of America.” The Supreme Court’s latest decision comes on the heels of last month’s 6-3 ruling to abolish the pursuit of happiness from the three inalienable rights guaranteed by the Declaration of Independence. http://www.theonion.com/content/news_briefs/supreme_court_upholds_bill?utm_source=onion_rss_daily   Kudos to Justice Anthony Kennedy for saving The Bill of Rights and shame, shame, shame on those Justices who sought not to protect the Bill of Rights and who did solemnly swear to uphold those rights. From Wiki-  http://en.wikipedia.org/wiki/Oath_of_office#Federal_judicial_oaths

For readers are not familiar with The Onion, the Supreme Court Ruling is a satire and did not occur.  No Court has had issue with the Constitution Free Zone, yet.  When standing behind, beside or in front of the ACLU, keep in mind it may not stand up to protect all of The Bill of Rights either, “ACLU doesn’t mean all of the original 10 amendments because its policy No. 47 says, “Except for lawful police and military purposes, the possession of weapons by individuals is not constitutionally protected,” thereby ignoring the Second Amendment.”  http://www.stoptheaclu.com/archives/2008/09/06/aclu-very-selective-in-upholding-bill-of-rights/

Defending our borders, The U.S. Constitution and our privacy laws is a balancing act that will require Obama’s political vision be clear and forthright through out his entire Presidency.   Good luck with that theory of  a President being forthright though. Obama himself has barred the public from seeing his birth certificate, college transcripts, medical background, etc., so I’d say Obama’s privacy has been protected pretty dang well here in America.

September 30, 2008–Buried in the News Headlines “Pre-election Militarization of the North American Homeland. US Combat Troops in Iraq repatriated to “help with civil unrest” “

http://www.informationliberation.com/?id=25949  Well isn’t that just special?  Our US Troops are coming home!  The war isn’t over here or abroad by a long shot.

What’ I find really special is that we have been under A State of National Emergency since March 9, 1933 during the run on gold.  National Emergencies have since been re-declared by President Truman on December 12, 1950 during the Korean Conflict and by Nixon in March of 1970 then again in August of 1971.  Declaring a State of Emergency allows for the President of the United States of America to have provisions in Federal Law that give him power with out consistutional process.  Some 75 years, later, America remains under A State of National Emergency as no one has rescinded them after passage.   A 1973 official report –Senate Report 93-549- admits that the Emergency Powers given to President Franklin D. Roosevelt under the pretense of the National Emergency of 1933 have remained in force and that the normal function of the Federal government has been suspended.  Almost all of my life has been lived under A State of Emergency.  Who’d a thunk it?

Hold your horses and wait a minute-  On October 29, 2003, President Bush, Sr.  extended the National Emergencies Act  (50 U.S.C. 1622(d)) that continued from Presidnet Clinton’s term for another year in Executive Order 12938, regarding the Weapons of Mass destruction http://www.whitehouse.gov/news/releases/2003/10/20031029-8.html   That year has passed has but I don’t beleive the State of National Emergency has been recinded yet (nor of course have we found those WMD’s.)  I doubt it would have unknowingly just expired- Or could it have just been replaced by some other law on the books?

Homeland Security Updates, The USA PATRIOT Act, The Intelligence Reform and Terrorism Prevention Act of 2004, and the Protect America Act of 2007, etc.,  all promote security, while protecting our fundimental liberties.  Don’t they?  Maybe we don’t need to be under a State of National Emergency at all in order for the President- as stated in the Senate Resolution, that  “The President may: Seize property, organize commodities, assign military forces abroad, institute Martial Law, seize and control and transportation and communication, regulate operation of private enterprise, restrict travel, and in a plethora of particular ways, control the lives of all American citizens”.  Say, what?

I find it ironic that the original  “National Emergency” declared by Congress was brought on by a run on the banks when Herbert Hoover sent a letter to the Federal Reserve looking for recommendations as to what he might with regards to problems in the banking institutions.  We still haven’t learned our lessions and here America sits in another banking and Wall Street fiasco with our current President George W. Bush asking for a $700 Billion dollar bail out.  Is it even worth it to take what little cash might be in the bank out?   It’s just paper after all and pretty soon the World Bank is probably going to issue One World Money, as predicted by the consipiracy folks long ago.  And I was worried about the Amero replacing our greenback!  But wait, what if chaos really should occur here in the US?  Our soldiers to the recscue!  http://www.armytimes.com/news/2008/09/army_homeland_090708w/  The 3rd Infantry Division’s 1st Brigade Combat Team has spent 35 of the last 60 months in Iraq patrolling in full battle rattle, helping restore essential services and escorting supply convoys.  Now they’re training for the same mission — with a twist — at home.  Beginning Oct. 1 for 12 months, the 1st BCT will be under the day-to-day control of U.S. Army North, the Army service component of Northern Command, as an on-call federal response force for natural or man made emergencies and disasters, including terrorist attacks.

“Now, the plan is to assign a force every year.” according to Army Col. Louis Vogler, chief of NorthCom future operations.  So this is what it comes down to?   No money.  No rules.  The Army on Hand to protect us from ourselves.  An election year to boot.  Is it all just a theater for the masses?

There is no greater place than America.

Ahrcanum.
